General terms of contract for the use of sinottica.ai and related services, governed by the law of the Republic of San Marino. By using the site or activating a subscription you accept them in full.

This English text is a courtesy translation. The Italian version at sinottica.ai/termini.html is the only binding one: in case of any discrepancy, the Italian text prevails.
Sinottica is a trade name, not a company. The service is provided by Piero Martino, Via Oreste Brizi 1, 47891 Dogana, Republic of San Marino, who can be reached at info@sinottica.ai. Full tax details are shown on the invoice.
Sinottica publishes market analysis produced with quantitative models: bulletins, reads with weighted factors, confidence indicators and decay conditions, on crypto, US stocks, indices and futures. The content is informative and general in nature.
Sinottica is not a financial intermediary and does not provide investment advice. The reads are not personalised financial advice, an investment recommendation, an offer to the public, or portfolio management. They do not take into account your financial situation, your objectives or your risk appetite. Every investment decision is yours and yours alone.
Past results shown in the public record are in no way a guarantee of future results. Financial markets carry the risk of losing the capital invested, up to its entirety.
To access the paid plans you must create an account, be of legal age and provide true, up-to-date details. Credentials are personal: you are responsible for keeping them safe and for the activity carried out with your account. An account cannot be shared between several people or transferred to third parties; if we detect shared access we may suspend the service.
The Free plan is free of charge. The Live and Lab plans are paid, billed monthly or annually in advance, and renew automatically on expiry unless cancelled from your profile before renewal. The prices shown on the site are in euro and include any taxes applicable under San Marino law. For customers subject to taxation in other jurisdictions, any taxes due in their country of residence are payable by them and are calculated at the time of payment.
Payment is made through the providers indicated at the time of purchase. If a payment fails, access to the paid features is suspended until the position is settled. We may change prices with at least thirty days' notice: the change takes effect from the next renewal and, if you do not accept it, you can cancel at no cost.
Within fourteen days of the first payment you can withdraw and obtain a full refund, without having to give a reason: just write to amministrazione@sinottica.ai. The refund is made within fourteen days of the request, using the same payment method used for the purchase. The right applies once per account.
After that deadline you can cancel whenever you like: the subscription stays active until the end of the period already paid for, and no partial refunds are made for periods under way.
You can use the reads for your own personal decisions and quote brief extracts from them, citing the source. What you cannot do is:
The trade mark, the name, the interfaces, the models, the methodology and the content published remain owned by Piero Martino, owner of the Sinottica trade mark, or by their respective licensors. The subscription grants a personal, non-exclusive, non-transferable and revocable licence to use them, limited to the duration of the relationship. Nothing in these terms transfers intellectual property rights.
We do what we can to keep the service available and up to date, but we do not guarantee absolute continuity: interruptions are possible for maintenance, faults, unavailability of data providers or force majeure. We may change, add or remove features; if a change substantially reduces the value of the plan you have paid for, we tell you in advance and you can cancel with a refund of the unused portion.
The number and frequency of the reads depend on market conditions: in periods when the weights do not clear the noise threshold, the service may produce no read at all. This is a feature of the method and is not a breach of contract.
To the extent permitted by law, Sinottica is not liable for financial losses arising from investment decisions taken on the basis of the content published, nor for errors, delays or gaps in data supplied by third parties. Liability for wilful misconduct and gross negligence, and the mandatory rights granted to consumers by the applicable law, remain unaffected. Where liability is established, it is in any case limited to the amount paid for the service in the twelve months before the event.
The contract runs until cancellation. We may suspend or close an account in the event of a serious breach of these terms, non-payment or fraudulent use, giving notice of it. On termination you lose access to the paid features; the public record remains open to everyone.
The contract is governed by the law of the Republic of San Marino. Any dispute falls within the jurisdiction of the Tribunale Unico of the Republic of San Marino. If you are a consumer resident in another State, any more favourable mandatory provisions of the law of your country of habitual residence, and the courts provided for there, remain unaffected.
The processing of personal data is described in the privacy policy, drafted under Law No. 171 of 21 December 2018. If any clause of these terms turns out to be invalid, the remaining ones stay in force.
